Privacy Policy - GDPR

I. Basic Provisions
The data controller according to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter "GDPR") is Valerie Cremonini, with registered office at: Na Vyhlídce 1893/5, 251 01, Říčany, ID 21780790 (hereinafter "controller").

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be directly or indirectly identified, in particular by reference to an identifier such as a name, identification number, location data, network identifier, or one or more specific elements of physical, physiological, genetic, mental, economic, cultural, or social identity.
The controller has not appointed a data protection officer.
II. Sources and Categories of Processed Personal Data
The controller processes personal data that you have provided or personal data that the controller has obtained based on fulfilling your order.
The controller processes your identification and contact details and data necessary for the performance of the contract.
III. Legal Basis and Purpose of Processing Personal Data
The legal basis for processing personal data is:
- the performance of a contract between you and the controller under Article 6(1)(b) GDPR,
- the legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(f) GDPR,
- your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services, if no goods or services were ordered.
The purpose of processing personal data is:
- to fulfill your order and perform the rights and obligations arising from the contractual relationship between you and the controller; personal data required for successful order fulfillment (name and address, contact) is necessary for concluding and performing the contract, without providing personal data, the contract cannot be concluded or performed by the controller,
- to send commercial communications and conduct other marketing activities.
The controller does not engage in automated individual decision-making under Article 22 GDPR. You have given explicit consent for such processing.
IV. Data Retention Period
The controller retains personal data:
- for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years from the end of the contractual relationship),
- until the consent for processing personal data for marketing purposes is withdrawn, for a maximum of 2 years if personal data is processed based on consent.
After the retention period, the controller will delete personal data.
V. Recipients of Personal Data (Subcontractors of the Controller)
Recipients of personal data are:
- entities involved in the delivery of goods/services/payment processing based on the contract,
- entities providing e-shop operation services and other services related to the operation of the e-shop,
- entities providing marketing services.
The controller does not intend to transfer personal data to a third country (outside the EU) or international organization.
VI. Your Rights
Under the conditions set out in the GDPR, you have:
- the right to access your personal data under Article 15 GDPR,
- the right to rectify personal data under Article 16 GDPR, or to restrict processing under Article 18 GDPR,
- the right to erase personal data under Article 17 GDPR,
- the right to object to processing under Article 21 GDPR, and
- the right to data portability under Article 20 GDPR,
- the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Article III of these terms.
You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your personal data protection rights have been violated.
VII. Data Security Conditions
The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
The controller has taken technical measures to secure data storage and personal data in paper form.
The controller declares that only authorized persons have access to personal data.
VIII. Final Provisions
By submitting an order through the online order form, you confirm that you are familiar with the privacy protection terms and that you accept them in full.

The controller is entitled to change these terms. The new version of the privacy protection terms will be published on its website and will be sent to you by email at the address you provided to the controller.
These terms come into effect on August 25, 2024.
